Agreement to Terms
By downloading, accessing, or using Fuelstate, you agree to be bound by these Terms of Service. If you do not agree, do not use the app.
These Terms constitute a legally binding agreement between you and Fuelstate ("we," "us," "our") regarding your use of the Fuelstate iOS application and related services (the "Services"). You must be at least 13 years old (or the minimum age required in your jurisdiction with parental consent) to use the Services.
Our Services
Fuelstate is a precision endurance nutrition app that calculates personalized fuel plans for runners and endurance athletes. The Services include carbohydrate, hydration, and sodium recommendations based on your inputs and the latest sports-science research.
The information provided through the Services is intended for use only in jurisdictions where doing so is lawful. We make no claim that the Services are appropriate or available in all locations.
Intellectual Property Rights
We are the owner or licensee of all intellectual property rights in the Services, including all source code, databases, functionality, software, designs, audio, video, text, photographs, and graphics (the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks").
The Content and Marks are provided in or through the Services "AS IS" for your personal, non-commercial use only. Except as expressly permitted, no part of the Services may be copied, reproduced, republished, uploaded, posted, distributed, sold, or otherwise exploited for any commercial purpose without our express prior written permission.
User Representations
By using the Services, you represent and warrant that:
- All registration information you submit is true, accurate, current, and complete
- You will maintain the accuracy of such information and update it as necessary
- You have the legal capacity and agree to comply with these Terms
- You are not a minor in your jurisdiction, or you have parental permission
- You will not access the Services through automated or non-human means
- You will not use the Services for any illegal or unauthorized purpose
- Your use will not violate any applicable law or regulation
Subscriptions & Payment
Fuelstate offers premium features through an auto-renewing subscription processed via Apple in-app purchase. By subscribing, you authorize Apple to charge the applicable subscription fee to your Apple ID at the rate then in effect.
Auto-renewal
Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can manage and cancel your subscription at any time through iOS Settings → your name → Subscriptions.
Refunds
All payments are processed by Apple and are subject to Apple's refund policy. We are unable to issue refunds directly. To request a refund, contact Apple Support at reportaproblem.apple.com.
Free trials
If a free trial is offered, you will not be charged until the trial period ends. Cancel before the trial expires to avoid being charged.
Prohibited Activities
You may not access or use the Services for any purpose other than that for which we make them available. You agree not to:
- Reverse engineer, decompile, or attempt to extract source code from the app
- Use any data mining, robots, or similar data gathering tools
- Make any unauthorized use, including collecting usernames or emails for unsolicited purposes
- Use the Services in a manner inconsistent with applicable laws or regulations
- Attempt to bypass any security or rate-limiting measures
- Upload or transmit viruses, malware, or other malicious code
- Harass, abuse, or harm another person through the Services
Mobile Application License
If you access the Services via the Fuelstate iOS app, we grant you a revocable, non-exclusive, non-transferable, limited license to install and use the app on Apple devices that you own or control, in accordance with these Terms and the Apple App Store Terms of Service.
You shall not (i) decompile, reverse engineer, or disassemble the app; (ii) make any modification, adaptation, or derivative work; (iii) remove any proprietary notices; or (iv) use the app for any revenue-generating endeavor or commercial enterprise without our express permission.
Third-Party Websites and Content
The Services may contain links to third-party websites or display content from third parties (such as nutrition product information). We are not responsible for the accuracy, availability, or content of any third-party services. Inclusion of any link does not imply endorsement.
Privacy Policy
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to our collection and use of your data as described therein.
Term and Termination
These Terms remain in full force and effect while you use the Services. We reserve the right to, in our sole discretion and without notice or liability, deny access to and use of the Services to any person for any reason, including breach of these Terms or applicable law.
You may terminate your account at any time via in-app account deletion or by contacting [email protected].
Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Services at any time, for any reason, in our sole discretion. We will not be liable for any modification, suspension, or discontinuance of the Services.
We cannot guarantee the Services will be available at all times. We may experience hardware, software, or other problems requiring maintenance, resulting in interruptions or errors. You agree we have no liability for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime.
Governing Law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict of law provisions. Any legal action arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of such courts.
Dispute Resolution
Informal negotiations
To expedite resolution and reduce costs, you and Fuelstate agree to first attempt to resolve any dispute informally for at least 30 days before initiating any legal action.
Binding arbitration
If the parties are unable to resolve a dispute through informal negotiations, the dispute shall be finally and exclusively resolved by binding arbitration on an individual basis under the rules of the American Arbitration Association. You waive your right to a jury trial and to participate in any class action.
Disclaimer
THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT, INCLUDING NUTRITION RECOMMENDATIONS, AND ASSUME NO LIABILITY FOR ANY ERRORS OR INACCURACIES.
Limitations of Liability
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.
Indemnification
You agree to defend, indemnify, and hold us harmless from any loss, damage, liability, claim, or demand made by any third party due to or arising out of: (1) your use of the Services; (2) your breach of these Terms; (3) your violation of the rights of a third party; or (4) any overt harmful act toward any other user of the Services.
Sports Nutrition Disclaimer
Fuelstate is not a substitute for professional medical or nutritional advice. The recommendations are general guidance based on sports-science research and your inputs — not personalized medical advice.
Always consult a physician, registered dietitian, or qualified sports-nutrition professional before:
- Beginning a new exercise or nutrition program
- Making significant changes to your fueling protocol
- Using the Services if you have any medical condition (including but not limited to diabetes, gastrointestinal disorders, or eating disorders)
- Using the Services if you are pregnant, nursing, or under 18
You assume full responsibility for any consequences arising from your use of the Services' nutrition recommendations. Individual responses to nutrition vary; what works for one athlete may not work for another. Always test your fueling strategy in training before using it in a race.
Fuelstate is not responsible for any adverse effects, injuries, or outcomes resulting from your reliance on the recommendations provided.
